Terms of Use - NOTON Speed Camera Alert (iOS)

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Ignacio Garcés ("Developer", "we", "our") regarding the use of the NOTON Speed Camera Alert mobile application for iOS ("the Application").

By using the Application, you confirm that:

• You have read and understood these Terms
• You agree to comply with all terms and conditions
• You are over 18 years of age or have parental/guardian consent
• You have a valid driver's license (if using the app while driving)

If you do not agree with these Terms, DO NOT use the Application.

2. Service Description

NOTON is a driving assistance application that provides:

• Proximity alerts for traffic speed cameras (fixed, mobile, sections)
• Periodically updated speed camera location database
• Management of favorite locations and routes
• Customizable sound and visual alerts
• Background location functionality

3. License to Use

The Developer grants you a limited, non-exclusive, non-transferable, and revocable license to:

• Download and install the Application on iOS devices you own
• Use the Application exclusively for personal and non-commercial purposes
• Use the Application in accordance with these Terms and applicable laws

License Restrictions:

You MAY NOT:

• Copy, modify, distribute, sell, or rent the Application
• Reverse engineer, decompile, or disassemble the Application
• Use the Application for commercial purposes without authorization
• Remove copyright notices or trademarks
• Use the Application for illegal or fraudulent activities
• Extract data from the Application using automated methods

4. Responsible Use and Road Safety

By using NOTON, you acknowledge and agree that:

• Driver responsibility: You are solely responsible for driving safely and complying with all traffic laws
• No guarantee of alerts: The Application may not detect all speed cameras or may generate incorrect alerts
• Respect for speed limits: Alerts DO NOT authorize exceeding established speed limits
• Attention to the road: You must maintain your attention on driving, not on the Application
• Safe configuration: Configure the Application BEFORE driving, never while driving
• Legality: It is your responsibility to verify that the use of speed camera detectors is legal in your jurisdiction

Disclaimer for Fines:

The Developer is NOT responsible for:

• Traffic fines received while using the Application
• Accidents or damages occurring during use of the Application
• Loss of driver's license points
• Legal consequences for speeding

5. Speed Camera Database

The speed camera database provided by NOTON:

• Is updated periodically but may not be 100% current
• Comes from multiple sources (contributors, public data)
• May contain errors, omissions, or outdated data
• Does NOT include all temporary mobile speed cameras
• Is provided "AS IS" without guarantees of accuracy

The Developer does not guarantee that the database is complete, up-to-date, or error-free.

6. In-App Purchases

NOTON offers in-app purchases managed by Apple:

Remove Ads:

• Type: One-time, non-recurring purchase
• Processing: Apple processes all payments according to their Terms of Use
• Effect: Permanently removes all advertising from the Application
• Restoration: You can restore the purchase on any iOS device associated with your Apple ID

Refund Policy:

Refunds for in-app purchases are managed exclusively by Apple:

• Request refunds through reportaproblem.apple.com
• Apple decides refund approval according to their policy
• The Developer CANNOT process refunds directly

Additional Subscription Terms (if applicable):

If NOTON offers auto-renewable subscriptions in the future:

• The price and duration will be clearly displayed before purchase
• The subscription will automatically renew unless you cancel it 24 hours before the end of the period
• You can manage and cancel subscriptions from iOS Settings → Apple ID → Subscriptions
• No refunds are offered for unused periods when canceling

7. Permissions and Privacy

To function properly, NOTON requests the following permissions:

• Location (Always): Required to detect nearby speed cameras in the background
• Tracking (ATT): Optional, to display personalized ads

8. Intellectual Property

All intellectual property rights to NOTON belong to the Developer, including:

• Application source code
• Design, user interface, and graphics
• Logos, trademarks, and trade names
• Content and documentation

Note: The speed camera database may contain data from public sources and contributors. Use of this data is subject to their respective licenses.

9. Limitation of Liability

The Developer does NOT warrant that:

• The Application will function without errors or interruptions
• Defects will be corrected
• The Application will meet your expectations or specific needs
• Speed camera alerts will be accurate or complete

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, data, or use
• Traffic accidents or fines
• Damages caused by database errors
• Service interruptions

Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

10. Service Availability

The Developer reserves the right to:

• Modify, suspend, or discontinue the Application at any time
• Update the speed camera database according to availability
• Change features or functionalities without prior notice
• Deny service to any user for violation of these Terms

11. Termination

This agreement is effective until terminated by you or the Developer.

Termination by User:

You may terminate this agreement at any time by uninstalling the Application from all your devices.

Termination by Developer:

The Developer may terminate or suspend your access if:

• You violate these Terms of Use
• You use the Application for illegal purposes
• You attempt to access the Application in an unauthorized manner

Upon termination, you must stop using the Application and remove it from all your devices.

12. Changes to Terms

The Developer reserves the right to modify these Terms at any time. Changes will be notified through:

• Updating the "Last updated" date at the beginning of this document
• Notification within the Application (for important changes)

Continued use of the Application after changes to the Terms constitutes your acceptance of the new terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict of law principles.

Any dispute related to these Terms or the Application shall be submitted to the exclusive jurisdiction of the courts of Spain.

14. General Provisions

• Entire agreement: These Terms constitute the entire agreement between you and the Developer
• Severability: If any provision is invalid, the rest shall remain in force
• Waiver: Failure to enforce a right does not constitute a waiver of that right
• Assignment: You may not transfer your rights under these Terms without consent

15. Apple Standard License Agreement (EULA)

These Terms are complemented by Apple's Standard End User License Agreement (EULA). In case of conflict, these Terms shall prevail over Apple's standard EULA.
